1. Scope of Application
These General Terms and Conditions ("GTC") apply to all business relationships between Cornelia Gunz and her clients. Cornelia Gunz provides services in the field of graphic and web design as well as coaching. She owns and operates the website www.connygunz.com.
A client refers to any natural person who maintains business relationships with Cornelia Gunz.
These GTC apply exclusively. Any terms and conditions that contradict, supplement, or deviate from these GTC require explicit written confirmation from Cornelia Gunz for their validity.
By using the services of Cornelia Gunz or entering into a contract, the client confirms comprehensive acceptance of these GTC.
2. Information
www.connygunz.com contains information about services. Price changes and other modifications are reserved. All information on www.connygunz.com (service descriptions, illustrations, films, PDF files, and other information) are to be understood as approximate values and do not constitute any assurance of characteristics or guarantees unless explicitly stated otherwise. 3. Conclusion of Contract
The conclusion of the contract is established by accepting the offer from Cornelia Gunz. The contract is also concluded when the client makes use of the services offered by Cornelia Gunz.
4. Prices
Unless otherwise specified in offers, all prices are gross in Swiss Francs (CHF).
Cornelia Gunz reserves the right to change prices at any time. The prices agreed upon at the time of conclusion of the contract shall apply.
5. Payment
The client undertakes to pay for the services of Cornelia Gunz as described in the offer.
For all graphic and web services, an advance payment of 1/3 of the accepted offer is to be paid.
If the client pays by installment, she/he is obliged to make the payment within 10 days. Upon expiry of this period, she/he automatically defaults and owes a reminder fee of CHF 20.- for the first reminder and an additional CHF 30.- for the second reminder. From the time of default, she/he also owes default interest at the rate of 5% per annum.
The client agrees that Cornelia Gunz may disclose personal data and invoices to third parties for the purpose of collecting her fees.
Offsetting the invoiced amount against any claim of the client against Cornelia Gunz is not permitted.
Cornelia Gunz reserves the right to refuse further provision of services in case of payment default by the client.
6. Rights and Obligations of Cornelia Gunz
Subject to any contrary agreement, Cornelia Gunz fulfills her obligation by providing the agreed service.
Cornelia Gunz expressly has the right to engage auxiliary persons to fulfill her contractual obligations. She must ensure that the engagement of auxiliary persons complies with all mandatory legal provisions and any applicable collective labor agreements.
7. Rights and Obligations of the Client
Cornelia Gunz assumes that the information and documents provided by the client are correct, complete, and comply with the legal obligations to cooperate and provide information.
The client has the right to cancel agreed appointments up to 24 hours in advance. Cancellations made thereafter will be invoiced at the full rate.
8. Termination
Both parties have the right to terminate the contract at any time. The client must fully reimburse Cornelia Gunz for any expenses already incurred. Termination at inappropriate times is not permitted.
9. Data Protection
The data protection provisions of Cornelia Gunz for the website www.connygunz.com are an integral part of these GTC.
10. Amendments
These General Terms and Conditions may be amended by Cornelia Gunz at any time. The new version comes into effect by publication on the website www.connygunz.com.
For the client, the version of the GTC that is in force at the time of conclusion of the contract generally applies. Unless she/he has agreed to a newer version of the GTC.
11. Confidentiality
Cornelia Gunz undertakes to treat all information she has obtained from the client in connection with her services confidentially. This obligation remains in force even after the termination of the contract.
12. Additional Provisions
Should individual provisions of these GTC be wholly or partially invalid and/or ineffective, the validity and/or effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. The invalid and/or ineffective provisions shall be replaced by provisions that come economically closest to the purpose and intent of the invalid and/or ineffective provisions in a legally effective manner. The same applies in the event of any gaps in the regulation.
